General Scope of Services
All services provided by OverLand Lawn & Landscape are limited to the specific work, materials, and services agreed upon in writing between OverLand Lawn & Landscape and the Customer. Any services, materials, repairs, improvements, or modifications not specifically included in the agreed scope of work shall be considered additional work and may require additional charges.
Customer Responsibilities
Customer is responsible for providing accurate property information, making timely selections and approvals, providing reasonable access to work areas, and notifying OverLand Lawn & Landscape of any known site conditions, restrictions, hazards, or underground utilities that may affect the work.
Delays caused by Customer, restricted access, lack of approvals, or changes requested after work has begun may result in schedule adjustments and additional costs.
Natural Conditions & Site Limitations
Customer acknowledges that landscape installation and maintenance are performed within existing environmental and site conditions. OverLand Lawn & Landscape does not guarantee against natural settling, soil movement, erosion, drainage changes, cracking, shifting, weather-related damage, or other conditions caused by natural processes or circumstances outside of its control.
Existing grading, drainage patterns, soil composition, subsurface conditions, climate, and environmental factors may affect the long-term performance and appearance of landscapes. OverLand Lawn & Landscape is not responsible for issues resulting from pre-existing conditions or changes occurring after completion of services.
Hardscape Materials
Concrete, pavers, natural stone, masonry products, and other hardscape materials are subject to normal variations in color, texture, cracking, settling, movement, and weathering. Minor cracking, settling, shifting, discoloration, or material variation resulting from normal characteristics, environmental conditions, or soil movement shall not be considered defects.
Naturally sourced materials, including but not limited to flagstone and natural stone products, may experience variations, erosion, delamination, cracking, and discoloration due to natural weathering processes.
Plant Material & Landscape Establishment
Plant material requires proper care and maintenance following installation. Customer is responsible for providing appropriate watering, maintenance, and care unless otherwise agreed upon in writing.
OverLand Lawn & Landscape is not responsible for plant loss, decline, or damage resulting from inadequate watering, overwatering, weather conditions, soil conditions, pests, disease, animals, neglect, improper maintenance, irrigation failures, or other factors outside of its control.
Irrigation & Water Management
Unless specifically included as part of the contracted services, irrigation repairs, troubleshooting, system modifications, and water management are excluded.
OverLand Lawn & Landscape is not responsible for landscape damage, plant loss, or turf loss caused by irrigation system failures, broken components, improper programming, water restrictions, leaks, inadequate water supply, or conditions outside of its control.
Utilities & Underground Conditions
OverLand Lawn & Landscape is not responsible for damage to unmarked or improperly marked utilities, irrigation lines, electrical lines, drainage systems, or underground obstructions. Customer is responsible for providing accurate information regarding known underground utilities or site conditions.
Unforeseen conditions including, but not limited to, rock, buried debris, poor soil conditions, concrete, utility conflicts, structural concerns, or drainage issues may require additional work and costs.
Maintenance Service Conditions
Routine landscape maintenance does not include removal of pet waste, animal droppings, wildlife waste, animal carcasses, biohazards, hazardous materials, trash, illegal dumping, or debris unrelated to normal landscape maintenance.
OverLand Lawn & Landscape reserves the right to modify, delay, or suspend services when unsafe, unsanitary, or inaccessible conditions exist, including but not limited to excessive pet waste, aggressive animals, standing water, locked gates, construction activity, or other hazards.
Additional cleanup, return trips, repairs, or specialized services required due to these conditions may result in additional charges.
Weather & Natural Events
Landscape services may be affected by weather conditions, including excessive heat, rain, snow, freezing temperatures, drought, storms, or other environmental factors. OverLand Lawn & Landscape will make reasonable efforts to complete scheduled work but is not responsible for delays or impacts caused by conditions outside of its control.
OverLand Lawn & Landscape is not responsible for damage caused by weather events, natural disasters, pests, insects, animals, erosion, drainage issues, or other natural occurrences.
Damage & External Factors
OverLand Lawn & Landscape is not responsible for damage caused by animals, rodents, insects, vehicles, third parties, vandalism, freezing, weather events, natural disasters, or other circumstances outside of its control.
Any repairs, alterations, modifications, or work performed by Customer or a third party to areas serviced or installed by OverLand Lawn & Landscape may void applicable warranties or responsibilities.
Access & Safety
OverLand Lawn & Landscape reserves the right to suspend or modify work when unsafe conditions, hazardous materials, lack of access, restricted areas, or other circumstances prevent safe completion of services.
Material Availability & Substitutions
OverLand Lawn & Landscape reserves the right to make reasonable substitutions of materials due to availability, manufacturer changes, supply chain issues, or circumstances beyond its control. Substituted materials will be of equal or similar quality and intended function.
Additional Work
Any work requested outside the agreed scope of services must be approved and may result in additional charges. Additional work, repairs, cleanup, return trips, or services outside the agreed scope will be billed at OverLand Lawn & Landscape’s current rates unless otherwise agreed upon in writing.
